Instructions on Withdrawal

Right of Withdrawal

You have the right to withdraw from this contract within fourteen days without giving any reason.

The withdrawal period is fourteen days from the day on which you acquire, or a third party other than the carrier and indicated by you acquires, physical possession of the artwork.

If several goods are ordered as part of a single order and delivered separately, the withdrawal period begins on the day on which you acquire, or a third party other than the carrier and indicated by you acquires, physical possession of the last item.

To exercise your right of withdrawal, you must inform us

St’Art Atelier, Sarah Bracke, Greifswalder Strasse 196, 10405 Berlin, Germany

E-Mail: widerruf@startatelier.de

of your decision to withdraw from this contract by means of an unequivocal statement, for example by a letter sent by post or by email.

You may use the model withdrawal form set out below for this purpose, but it is not obligatory.

You may also exercise your right of withdrawal online via our withdrawal function at

Withdraw from Contract

If you use this online function, we will provide you, without undue delay, with an acknowledgement of receipt on a

durable medium, for example by email, containing information on the content of the withdrawal declaration and the date and time of its receipt.

To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.

Effects of Withdrawal

If you withdraw from this contract, we shall reimburse you for all payments received from you, including the costs of delivery – with the exception of any supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us – without undue delay and in any event no later than fourteen days from the day on which we receive notification of your withdrawal from this contract.

We will carry out the reimbursement using the same means of payment as you used for the initial transaction, unless expressly agreed otherwise with you. In any event, you will not incur any fees as a result of the reimbursement.

We may withhold reimbursement until we have received the artwork back or until you have supplied evidence of having sent the artwork back, whichever is the earlier.

You shall send back the artwork or hand it over to us without undue delay and in any event no later than fourteen days from the day on which you communicate your withdrawal from this contract using the address stated above.

The deadline is met if you send back the artwork before the period of fourteen days has expired.

You will have to bear the direct cost of returning the goods.

You are only liable for any diminished value of the artwork resulting from handling other than what is necessary to establish the nature, characteristics and functioning of the artwork.

Exclusion of the Right of Withdrawal for Individually Made Artworks

The right of withdrawal does not apply to contracts for the supply of artworks that are not prefabricated and are made on the basis of an individual choice of or decision by the consumer, or which are clearly tailored to the consumer’s personal needs.

This applies in particular to individually commissioned artworks whose execution is based on specific instructions from the client and which are produced only on the basis of those individual instructions.

The mere fact that an artwork is an original, a one-off piece or unique does not in itself exclude the right of withdrawal.

Legal basis: Section 312g(2) No. 1 of the German Civil Code (BGB).
